01Services

FactionCBF Pte. Ltd. (“Company”) provides a platform that connects Content Creators (“Creators”), Brands, and Fans. Services include selling content, product promotions (“Bounty Boards”), and community features (“Guilds”). We reserve the right to update, remove, or charge for features in our sole discretion, with notice where required by law.

02Eligibility

Users must be 18 years old to register as Creators or Fans. Limited features may be available for users aged 13–17 with verified parental consent as required by law. We reserve the right to verify and enforce these requirements.

03Policies

By using the Service, you agree to all Company policies including the Privacy Policy and Acceptable Use Policy, which are incorporated into these Terms.

04Accounts

You are responsible for maintaining your account credentials. You agree to provide accurate information and to update it as needed. Inactivity for 36 months may lead to account termination. Accounts may not be sold, transferred, or shared without consent.

05Platform Payments and Earnings

Faction uses a digital payment system, the options for which will be introduced in phases. Earnings can be withdrawn in Singapore Dollars, subject to a 9% platform fee on standard transactions.

For donations and transactions under SGD 10.00, Faction does not charge a platform fee. Creators receive the full transaction amount net of any applicable third-party payment gateway fees.

Gateway fees are charged and deducted by the gateway provider (for example, PayPal), not by Faction. Such fees vary by gateway, transaction size, currency, payment method, and whether the transaction is domestic or international. As at the Effective Date of these Terms, PayPal's standard commercial transaction rates for Singapore-registered accounts are approximately 3.9% + SGD 0.50 for Singapore-domestic and 4.4% + SGD 0.50 for international transactions. These figures are illustrative only; the rates that apply to any given transaction are those set and published by the gateway provider at the time of the transaction.

Gateway rates, terms, and availability are determined by the gateway provider and may change at any time without notice from Faction. Faction makes no representation or warranty as to the accuracy or continued validity of any gateway fee figures stated in these Terms, and is not liable for any loss or reduction in earnings arising from changes to gateway fees, terms, or service availability. Creators are responsible for reviewing the then-current fees of any payment gateway used to receive funds through the Service.

Faction reserves the right, with reasonable notice where required by law, to adjust its platform fee, the SGD 10.00 small-transaction threshold, and its supported payment gateways and payment methods.

06License

We grant you a limited, non-transferable license to use the Service in accordance with these Terms. All intellectual property remains the property of the Company.

07User Content

You retain ownership of your content but grant us a global, royalty-free license to use, distribute, and promote it in connection with the Service. You confirm you have the rights to any content uploaded.

08Acceptable Use

You must not:

• Break any Singapore law or regulation.
• Harm minors or post inappropriate, illegal, or offensive content.
• Spam, phish, hack, or distribute malware.
• Infringe intellectual property rights.
• Use the platform for gambling or unapproved commercial purposes.

Faction reserves the right to remove content or terminate accounts for violations.

09Intellectual Property and Confidentiality

All system designs, trademarks, and service-related IP remain with the Company. Confidential information must not be disclosed without consent and must be safeguarded during and after your use of the Service.

10Suspension and Termination

Accounts may be suspended or terminated for violations of these Terms. Suspended users will be notified and may rectify violations within 10 days. We reserve the right to permanently delete content and currency without compensation.

12Survival

Clauses 1, 3–5, 7–11, and 13–21 remain enforceable after termination.

13Warranties and Limitations

The Service is provided “as is” without warranties. We do not guarantee uninterrupted service. Our liability is limited to the amount of platform currency purchased in the 30 days before a dispute arises.

14Indemnity

You agree to indemnify the Company against any third-party claims resulting from your use of the Service, including legal and expert costs.

15Force Majeure

We are not liable for service failures due to events beyond our control (e.g., natural disasters, pandemics).

16Assignment

You may not assign your rights under these Terms. We may assign our rights to successors or affiliated parties.

17Severability

If any part of these Terms is held invalid, the remaining provisions remain effective.

18Governing Law

These Terms are governed by Singapore law, including the Personal Data Protection Act 2012 (PDPA). Any disputes shall be resolved in Singapore courts.

19No Agency

No agency, partnership, or joint venture is created between you and the Company by these Terms.

20Amendments

We may update these Terms at any time. Changes will be posted on our website and are effective immediately upon posting.

21Data Protection and PDPA Compliance

We collect, use, and process your Personal Data in accordance with the PDPA. You may contact us to access, correct, or withdraw consent for your data at: contact@factioncbf.com.
